When Professor De Simone severed his relationship with the company in July 2016, his former partners attempted to sell an untested version of the product, passing it off as the original formula, and neglecting to inform patients or physicians of the change. In 2019, the distributors of VSL#3®* were found liable of false advertising by a federal court and ordered not to state or suggest a false continuity between VSL#3 and the De Simone Formulation.
